Terms of Service

These are the terms on which Holy Land Treasures LLC sells you a candle. They are meant to be read, so we have kept them short and written them in ordinary words.
Who these terms are between
This is an agreement between you and Holy Land Treasures LLC, of 3120 Southwest Fwy, Ste 101 #707208, Houston, TX 77098, USA. It governs your use of this website and any candle you order through it. By placing an order, you accept it.
What we do
You write an intention. We carry it into the Basilica of the Annunciation in Nazareth, light a real candle for it - wax, wick and flame - and email you a video of that candle burning.
You can buy a single candle, or a standing order that repeats every month until you cancel.
What we are not
Holy Land Treasures LLC is an independent business. We are not the Basilica of the Annunciation, and we are not affiliated with, endorsed by, or acting on behalf of the Franciscan Custody of the Holy Land, which administers the church. We light candles there as any visitor may.
Your payment goes to Holy Land Treasures LLC, not to the church, and no part of it is a donation to the church.
Who may order
You must be at least eighteen years old and able to enter into a contract. If you order on someone else's behalf, or write an intention naming them, you confirm you have good reason to believe they would not object.
Orders and prices
Two things are for sale:
- a single candle at $24.90, charged once;
- a monthly candle at $19.99 per month, charged each month until you cancel.
Prices are in US dollars. There is nothing to add - nothing is shipped, so there is no delivery charge. Your order is accepted when we send your confirmation email, not when you press pay. If we cannot accept it, we refund you in full.
Payment and renewal
Payment is taken by Stripe. For a monthly candle you authorise us to charge the same amount on the same day each month until you cancel.
We will tell you before any price change, and you may cancel instead of accepting it. If a payment fails we may retry it; if it keeps failing, the subscription ends and we stop lighting candles.
Cancelling
Cancel a monthly candle whenever you like - from the link in your confirmation email, or by writing to hello@basilicaoftheannunciation.com. It stops at the end of the month you have already paid for; we do not cut short a month you bought.
A single candle is not a subscription. There is nothing to cancel, and you will not be charged again.
Refunds
Our refund terms are set out in full on the Refunds page, and they form part of this agreement.
In short: a full refund at any time before we light your candle, and no refund once it has been lit and the video sent, because by then the service has been performed.
What you write
Your intention stays yours. You give us permission to read it, store it and use it for one purpose - lighting your candle - and for as long as we need in order to do that and keep our records.
Please do not send anything unlawful, threatening, hateful, or meant to harm a named person. We may decline an intention and refund you rather than light it, and if we do, we will tell you why.
Your video
We aim to send your video within seven days of each lighting.
Delays do happen - the church closes for feasts and for restoration, and we cannot always light on the day we planned. If your video has not arrived within seven days, write to us and we will either send it or refund you for that candle.
Using this site
Please do not attempt to break, overload or gain unauthorised access to this site, and do not use it to send us somebody else's personal information without their knowledge.
Our content
The text, photographs and design of this site belong to Holy Land Treasures LLC, or are used with permission.
The video of your candle is yours to keep and to share with whomever you wish. Please do not sell it or present it as your own work.
Privacy
What we do with your information is set out in our Privacy Policy, which forms part of this agreement.
What we promise, and what we do not
We promise to light a real candle for your intention, and to send you honest video of that candle. We promise to provide the service with reasonable care and skill.
We do not promise any spiritual, religious or personal outcome, and nothing on this site should be read as promising one. Lighting a candle is an act of remembrance and prayer. It is not a transaction with God, and we make no claim about what may follow from it.
Beyond what we have expressly promised, and so far as the law allows, we give no other warranties. Nothing here limits any right of yours that cannot lawfully be limited.
Limits on our liability
If we fail to do what we promised, we will put it right or refund you. Beyond that, our total liability to you for everything connected with this agreement is limited to what you paid us in the twelve months before the problem arose.
We are not liable for loss of profit, loss of opportunity, or any indirect or consequential loss.
We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not permit us to exclude.
If what you send us causes a problem
If somebody brings a well-founded claim against us because of what you wrote and sent, you agree to cover our reasonable costs of dealing with it.
This does not apply if you are a consumer acting outside a business or profession.
Ending this agreement
You may stop at any time by cancelling.
We may end an agreement if you break these terms, if we cannot lawfully continue, or if we stop offering the service - and in that case we refund anything you have paid for a candle not yet lit.
If you are a consumer in the EU or the UK
Nothing in these terms takes away the rights your own country gives you as a consumer. Where those rights conflict with anything written here, your rights win.
You have fourteen days to change your mind about a contract made at a distance. You may ask us to begin lighting your candle within those fourteen days; if we do, you accept that once that candle is lit the service has been fully performed and the right to cancel it is gone. You keep the right in full for any candle not yet lit.
You may also take a dispute to the consumer protection authority, or to an alternative dispute resolution body, in your own country. You are welcome to write to us first - we would much rather fix it.
Which law applies
These terms are governed by the law of the State of Texas, United States, and the courts there have jurisdiction.
If you are a consumer, this does not deprive you of anything: you may still bring proceedings in your own country, and the mandatory consumer law of your own country continues to protect you regardless of this clause.
Changes to these terms
We may change these terms, and the date at the top says when we last did.
For a monthly candle, a change takes effect at your next renewal and we will tell you beforehand, so that you can cancel instead of accepting it.
